Article 1 – Definitions
In these terms and conditions, the following definitions apply:
David’s Hof bvba: The entrepreneur who offers her products and services
Customer: the person or company who places an order with David’s Hof
Distance contract: the contract whereby sole use is made of one or more techniques for distance communication within the framework of a system organised by the trader for the distance sale of products and/or services, up to and including the moment that the contract is concluded.

Article 3 – Applicability
These General Terms and Conditions apply to every offer made by David’s Hof and to every distance contract concluded between the trader and the consumer.
Before the distance contract is concluded, the text of these general conditions will be made available to the consumer. If this is not reasonably possible, the trader will indicate, before the distance contract is concluded, that the general conditions are available for inspection at the trader’s premises and that they will be sent to the consumer free of charge as soon as possible, at the consumer’s request.
If the distance contract is concluded electronically, then, contrary to the previous paragraph, and before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer in electronic form in such a way that the consumer can easily store them on a durable data carrier. If this is not reasonably possible, prior to the conclusion of the distance selling agreement, it will be indicated where the general terms and conditions can be viewed electronically and that they will be sent to the consumer free of charge, at his request, either electronically or in some other way.
Article 4 – The offer
The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to allow a good assessment of the offer by the customer. If David’s Hof uses images, these are a true reflection of the products and / or services offered. Obvious mistakes or errors in the offer do not bind David’s Hof.
Every offer contains such information, that for the customer it is clear what the rights and obligations are, which are connected to the acceptance of the offer. This concerns in particular:
The price including taxes; the possible costs of delivery; the way in which the agreement will be established and which actions are necessary for that; the way of payment, delivery or implementation of the agreement;
Article 5 – The agreement
The agreement is concluded, subject to that which is stipulated in paragraph 4, at the moment at which the customer accepts the offer and fulfils the conditions laid down.
If the client has accepted the offer electronically, Davids’ Hof will immediately confirm receipt of electronic acceptance of the offer. As long as receipt of this acceptance has not been confirmed, the consumer may dissolve the contract.
If the contract is concluded electronically, David’s Hof will take appropriate technical and organisational measures to secure the electronic transfer of data and will ensure a secure web environment. If the customer can pay electronically, David’s Hof will take appropriate safety measures.
David’s Hof can – within legal frameworks – inform itself whether the customer can fulfill his payment obligations, as well as all those facts and factors which are important for a responsible conclusion of the distance contract. If, on the basis of this examination, David’s Hof has good reason not to conclude the contract, he is entitled to refuse an order or request while giving reasons, or to attach special conditions to the implementation.
Article 6 – The price
During the validity period mentioned in the offer, the prices of the products and/or services offered will not be increased, except for price changes due to changes in VAT rates.
Contrary to the previous paragraph, David’s Hof may offer products or services whose prices are subject to fluctuations in the financial market over which the company has no influence, at variable prices. This link to fluctuations and the fact that any prices mentioned are recommended prices will be stated with the offer.
Article 7 – Compliance and Warranty
David’s Hof guarantees that the products and/or services comply with the agreement, with the specifications listed in the offer, with the reasonable requirements of reliability and/or serviceability and with the existing legal provisions and/or government regulations on the date that the agreement was concluded.
No right of withdrawal is possible for any articles purchased on the website. Articles cannot be exchanged.
Article 8 – Delivery and execution
David’s Hof will take the greatest possible care when receiving and executing orders of products and when assessing applications for the provision of services.
The place of delivery is the address given by the customer.
If delivery of an ordered product turns out to be impossible, David’s Hof will make an effort to provide a replacement product. Not later than at the time of delivery, it will be clearly and comprehensibly reported that a replacement product will be delivered.
The risk of damage and/or loss of products rests with David’s Hof until the moment of delivery to the customer, unless expressly agreed otherwise.
Article 9 – Payment
All items purchased on the website have to be paid online.
The customer has the duty to report any inaccuracies in payment data provided or mentioned immediately to the entrepreneur.
Article 10 – Disputes
The agreement and these general conditions are governed by Dutch law.
Article 11 – Additional or different provisions
David’s Hof has the right to change these general conditions without any notice. The conditions shown on this site are the most recent.
Additional Information
Ordering: An order is definitively placed after going through the ordering process, agreeing with the general terms and conditions, choosing a payment method and the notification on your screen that your order has been placed.
Modifications: After the conclusion of the contract, you can only make changes that do not affect the total amount to be paid or the amount already paid and on condition that your order has not yet been processed. If a change can no longer be processed you will be informed as soon as possible. Changes can be made by email or telephone.
Payment methods: Mr. Cash (internet banking), Direct Banking, Paypal and Creditcard.
